As you might expect there are a few terms and conditions which apply
to our charitable work. Any organisation or individual applying for Belake
assistance will be bound by these terms and conditions.
- Within these terms, 'you' and 'your' refer to the person and/or the
organisation making the application, and 'Belake', 'we', 'our' and 'us'
refer to Belake and/or its representatives.
- Belake is an organisation based in England, and therefore these terms
will be governed only by the laws of England. If part of this agreement
is found to be contrary to English law, then only that part of the
agreement will be cancelled, and the remainder of these terms will
remain in force.
- You must recognise that because Belake is a not for profit organisation,
our project officers often work for little or no fee at Belake, in
addition to holding full time jobs in other organisations. Therefore
by applying for a project with Belake, you undertake to make all reasonable
endeavours to assist your assigned project officer in managing their
time. This may include, but is not limited to, meetings outside normal
working hours, schedule changes at short notice, remote working, working
over the internet, communicating via email, being unavailable for
contact at certain times of the day and so on.
- Belake will remain the owner and retain all copyrights of all data,
research, analysis, written material, computer files etc. completed
during the course of a project. However, all of these will be provided
(including source data and descriptions of data sources) to you at
the finish of the project, for use and reproduction without reference
to Belake only within your organisation for the purpose for which
it was initially intended. You will also pay due regard to any warnings about accuracy or relevance given by Belake in any written material, presentation or verbally.
- Belake reserves the right to use the material any project commissioned
under its charitable programme as evidence, samples, source material
or otherwise as part of any other of its activities. Any such use
of this information will be de-personalised and comprehensively anonymised
so that no individuals can be traced through such use. In exceptional
circumstances we may use the name of your organisation, although you
may request that this is not done as part of the initial project agreement.
- Most projects are likely to incur a small costs, and most will include
a minimal administration fee. Costs will be agreed with you prior
to the commencement of the project and will only change if amendments
are made the project in agreement with you. You will be invoiced following
the completion of the project as described in the agreed project brief,
and prompt payment should be made within 30 days of the invoice date.
- You indemnify Belake against any costs and liabilities arising from
any projects. Belake will in no way be liable for any decisions taken
as a consequence of a project. You recognise that Belake is just one
of many sources of advice and information which you could consult
before taking a decision, and as a result, Belake cannot be held responsible
for any consequences arising from a project, or a decision taken as
a result of a project. Belake cannot be held responsible for the success
or failure of any bid or application for grant, loan or other financial
or resource benefits which are based on information or advice given
by us.
- Belake cannot be held responsible for the delays and/or cancellations
of any project due to any circumstances that could not have reasonably
been foreseen. These include, but are not limited to, personal accident,
injury or illness, acts of terrorism, acts of government (either local
or national) acting lawfully or otherwise, war, natural disasters
either large or small.
- You understand that acceptance of an initial application form, and/or
indication from Belake or its representatives that this project has
been accepted for its charitable programme, will not constitute an
agreement that Belake will undertake the project until a formal project
specification has been agreed and signed by both sides.
